It's beginning to look like Freeport-McMoRan Copper & Gold's (NYSE: FCX ) acquisition of oil and gas produce Plains Exploration was prescient. The prospects of an extended closure of its huge Grasberg mine means its drilling operations may be what allows it to survive.
Two weeks ago, Freeport suffered a mine collapse in a training area that killed 28 workers. After temporarily suspending operations even though the area was away from its main mining operations, Freeport reopened the mine last week. But another accident on Friday, where a truck driver was killed when his vehicle was covered in wet sludge, had the mine workers union calling for a work stoppage and the government forcing the mine's closure until it completes its investigation, an inquiry that could take as long as three months to finish.
A deep hole to climb out of
Miners, of course, don't exist on immediate output alone; there is typically three to four weeks of stockpile to get by temporary setbacks. But Freeport has been cagey about how much of a reserve it has on hand, raising the possibility it could default on shipments to its customers. In 2011 it ran into that problem after a strike ran on, causing the miner to declare a force majeure that got it out of some of its contractual obligations.�

United Technologies (NYSE: UTX ) reported decent numbers, with net earnings ahead of expectations but growth driven more by acquisitions than by organic improvements in its existing businesses. Given the company's conglomerate setup, growth by bolt-on acquisitions isn't surprising, but over the long haul, it'd be better to see its businesses growing internally as well as through acquisitions. The news at Mine Safety Appliances (NYSE: MSA ) wasn't quite as good, with both revenues and net earnings falling from year ago levels on a tough environment for the mining businesses it supports. That's a risk well known to the company and its shareholders, though, and while the weaker results did knock the company's stock down, the business has ridden through tough cycles before. It looks capable of riding through this one, too. Hasbro (NASDAQ: HAS ) , on the other hand, reported earnings that beat expectations on an operating basis, before restructuring charges knocked it down to a net loss. Given that the company is in the very seasonal toy business, that loss in an off-peak quarter is much less of a concern than it would have been in the make-or-break holiday quarter. UPS (NYSE: UPS ) kept on trucking, with a better-than-expected January and strength from eCommerce helping the company turn in an 8% growth in net reported earnings per share. For Google, the shift in the way the justice system looks at and handles patent infringement claims meant its subsidiary, Motorola Mobility, unsuccessfully bid to convince U.S. courts that Apple Inc. (NASDAQ:AAPL) was illegally using Google's/Motorola's approach for sending data to a mobile device. For Akamai Technologies, it means that the technology company will need to re-explain - and ultimately re-prove - to an appellate court that Limelight Networks, Inc. (NASDAQ:LLNW) infringed on an Akamai patent even though a lower court had already ruled in favor of AKAM. And for Soverain Software, the legal system's new attitude meant it wouldn't even bother hearing its appeal for a case it lost against Newegg last year... a case it's tried against several companies, losing every time.
